Judge issues temporary restraining order for Marshall student who had legal status revoked

A temporary restraining order issued by a federal judge will allow a graduate student at Marshall University to return to class.

The American Civil Liberties Union of West Virginia filed a federal lawsuit after a student from India had his legal status revoked with less than a month before graduation.

Court documents said the student received a student visa for education in West Virginia and in doing so, disclosed a previous misdemeanor conviction.

A director with the ACLU told Eyewitness News the issue stemmed from a DUI that occurred out-of-state in 2020.

An expedited preliminary injunction hearing is scheduled for May 7.
