The News/Media Alliance said the decision recently issued by The Court of International Trade (CIT) was temporarilystayedby the U.S. Appeals Court for the Federal Circuit on May 29allowing the tariffs to continue to apply while it considers Trump’s appeal.
The administrative stay is expected to remain in effect through mid-June, according to a schedule laid out by judges.
Additionally, a federal judge in Washington D.C. issued a ruling (attached) in a case on May 29 against the Trump Administration (Learning Resources v. Trump, an Illinois-based educational toy company)determining that Trump’s global tariffs were unlawful.U.S. District Judge Rudolph Contreras said the International Emergency Economic Powers Act (IEPPA) does not give the president the power to impose most of his recent tariffs and ordered a preliminary injunction against collection of the tariffs under IEEPA,but only with respect to the two plaintiff companies, not more broadly.
Moreover, the court stayed its injunction for 14 days to allow for appeals, according to NMA.
