Court documents show Gannett wanted the case moved to the federal level because it involves parties in different states.
Additionally, the total damages involved in the case could amount to more than $5 million, qualifying it to be moved to federal court.
The potential class-action lawsuit was originally filed in Polk County District Court by the Center for American Rights on behalf of Dennis Donnelly, a West Des Moines resident.
The lawsuit alleges that Selzer, her polling company, the Register and its parent company, Gannett, misled consumers by releasing a Des Moines Register/Mediacom Iowa poll predicting Kamala Harris would win Iowa by 3 percentage points. President Donald Trump ended up winning the state by 13 points.
As a result, lawyers are seeking monetary damages for Donnelly and every other Des Moines Register subscriber in the amount equivalent to a one-year subscription to the Register.
